Terms and Conditions

Effective Date: September 6, 2026
Last Updated: September 6, 2026

These Terms and Conditions govern your access to and use of littlemothandmoon.com, including its online shop, content, digital products, communications, and related services.

Little Moth & Moon is a brand operated by Northside Marketing Inc., a Texas corporation. In these Terms, “Little Moth & Moon,” “we,” “us,” and “our” refer to Little Moth & Moon and Northside Marketing Inc. “You” and “your” refer to any visitor, customer, purchaser, account holder, or other user of our website or services.

Please read these Terms carefully. By accessing the website, creating an account, submitting information, or completing a purchase, you agree to be bound by these Terms. If you do not agree, do not use the website or purchase our products.

1. Related Policies

The following policies are incorporated into these Terms by reference:

  1. Privacy Policy, which explains how we collect, use, disclose, and protect personal information.
  2. Digital Product Policy, which governs digital delivery, licensing, compatibility, refunds, and use restrictions.

If a product page, offer, or written agreement contains additional terms, those additional terms also apply. If there is a direct conflict, the more specific terms governing the applicable product, offer, or service will control to the extent of the conflict.

2. Eligibility

You must be at least eighteen years old or the legal age of majority where you live to make a purchase, create an account, or enter into a binding agreement through the website.

A person under the applicable age may use the website only with the involvement, permission, and supervision of a parent or legal guardian. By using the website, you represent that you have the legal capacity and authority to agree to these Terms.

3. Website Use

We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the website for lawful personal purposes and to learn about or purchase Little Moth & Moon products and services.

You may not use the website in a way that damages, disables, overburdens, interferes with, or compromises the website, its security, its users, or its connected systems.

4. Accounts and Account Security

If customer accounts are available, you are responsible for providing accurate information, maintaining the confidentiality of your login credentials, and restricting access to your account and devices. You are responsible for activity conducted through your account unless prohibited by law.

Notify us promptly if you believe an account, password, purchase, or download link has been accessed or used without authorization. We may require verification before changing account information, restoring access, or discussing an order.

We may suspend or terminate an account reasonably believed to be compromised, fraudulent, abusive, or used in violation of these Terms.

5. Products and Product Information

We make reasonable efforts to describe our products accurately. Product images, mockups, screen previews, colors, dimensions, page counts, features, included files, and compatibility information are provided for general reference and may be updated.

Screen settings, devices, printers, paper, ink, applications, scaling, and third party software may affect how a digital product appears or prints. Minor variations that do not materially change the product are not defects.

Unless a product page expressly states otherwise, products sold through the website are digital and no physical item will be shipped.

6. Orders and Acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute acceptance. We may accept, reject, limit, or cancel an order when reasonably necessary, including because of suspected fraud, unauthorized payment, pricing or technical errors, product unavailability, legal restrictions, or violation of these Terms.

If we cancel a paid order before providing the product, we will issue an appropriate refund to the original payment method. We may request additional information to verify an order before delivery.

7. Prices, Payment, and Taxes

Prices are shown in the currency displayed during checkout and may change before purchase. You agree to pay the total amount presented at checkout, including applicable taxes and disclosed charges.

Payments are processed by third party providers. You represent that you are authorized to use the payment method submitted and that the billing information you provide is accurate.

We may correct an obvious pricing, calculation, or technical error where permitted by law. If a correction affects a completed order, we will notify you and provide any remedy required by applicable law.

8. Promotions and Discount Codes

Promotions, launch offers, discount codes, and limited time prices are subject to the terms stated with the offer. Unless expressly stated otherwise, they cannot be combined, transferred, redeemed for cash, extended, or applied to a previous purchase.

Little Moth & Moon promotion dates and deadlines use United States Central Time unless an offer expressly states otherwise. We may end or modify a promotion before a purchase is completed when reasonably necessary because of error, misuse, fraud, or circumstances outside our control, subject to applicable law.

9. Digital Products

All digital purchases are subject to our Digital Product Policy. That Policy includes important terms concerning electronic delivery, download access, file storage, compatibility, personal use licensing, prohibited use, intellectual property, refunds, and technical problems.

Purchasing a digital product grants only the limited license described in the Digital Product Policy. It does not transfer copyright, trademark rights, ownership, or permission to share, resell, reproduce, publish, or commercially exploit the product.

10. Refunds and Payment Disputes

Refund eligibility for digital products is governed by the Digital Product Policy and any mandatory consumer rights that apply. Because digital files can be accessed, copied, or used immediately, successfully delivered digital products are generally final sale.

If you believe a charge is incorrect, duplicated, unauthorized, or associated with a product that was not delivered, contact us promptly so we can investigate. We may provide transaction, delivery, download, communication, and policy acknowledgment records to a payment processor when responding to a chargeback or payment dispute.

Nothing in these Terms limits a right or remedy that cannot lawfully be limited.

11. Intellectual Property

The website and its content, including products, text, written guidance, artwork, tarot imagery, illustrations, logos, graphics, photographs, page layouts, visual treatments, downloads, audio, video, code, product names, and branding, are owned by or licensed to Northside Marketing Inc. and are protected by copyright, trademark, and other applicable laws.

Little Moth & Moon, The Lunaria Tarot, associated logos, and related product or collection names may be trademarks or proprietary brand identifiers. Nothing in these Terms grants permission to use our names, marks, trade dress, or branding.

You may not reproduce, distribute, publicly display, publicly perform, publish, modify, translate, adapt, trace, extract, sell, sublicense, or create derivative commercial materials from protected content without prior written permission, except where applicable law expressly permits the activity.

12. Prohibited Conduct

You agree not to:

  1. Use the website or our products for an unlawful, fraudulent, abusive, deceptive, or harmful purpose.
  2. Attempt to gain unauthorized access to accounts, systems, administrative areas, data, download links, or payment functions.
  3. Introduce malware, malicious code, harmful files, or disruptive technology.
  4. Scrape, crawl, harvest, copy, monitor, or extract website content or data through automated means without written permission.
  5. Bypass access controls, purchase limits, download restrictions, security features, or copyright protections.
  6. Share, resell, upload, distribute, or commercially exploit a digital product contrary to its license.
  7. Use our content, products, artwork, or files to train, fine tune, test, populate, or develop an artificial intelligence system, machine learning model, dataset, image generator, or text generator.
  8. Impersonate another person, misrepresent an affiliation, submit false information, or interfere with another user.
  9. Use the website to send spam, solicitations, or unauthorized promotional messages.
  10. Engage in conduct that infringes intellectual property, privacy, publicity, contractual, or other legal rights.

13. Reviews, Comments, and Other Submissions

If you submit a review, testimonial, comment, message, image, social media tag, suggestion, or other material, you represent that you have the right to submit it and that it is accurate, lawful, and does not violate another person’s rights.

You retain ownership of original content you create. When you intentionally submit content for public display or promotional consideration, you grant us a nonexclusive, worldwide, royalty free license to host, reproduce, format, and display that content for the purpose for which it was submitted. We will request permission before turning a private customer message into a public testimonial unless the submission method clearly states that it may be published.

We may moderate, decline, remove, or restrict content that is unlawful, misleading, abusive, irrelevant, infringing, contains private information, or violates these Terms. We are not required to publish any submission.

14. Spiritual and Educational Content

Little Moth & Moon provides content for personal reflection, inspiration, education, spiritual exploration, and entertainment. Astrology, tarot, moon cycle guidance, rituals, prompts, and related practices are interpretive and subjective.

We do not guarantee predictions, spiritual results, financial outcomes, relationships, healing, transformation, business success, or any other particular result. You are responsible for deciding whether and how to use the information provided.

15. No Professional Advice

Website content and products are not medical, mental health, legal, financial, tax, investment, career, relationship, or other licensed professional advice. They are not a substitute for diagnosis, treatment, counseling, legal representation, financial planning, or services from a qualified professional.

Do not delay or disregard professional assistance because of content from Little Moth & Moon. If you are experiencing an emergency or believe you may harm yourself or another person, contact emergency services or an appropriate crisis resource immediately.

16. Third Party Services and Links

The website may use or link to third party services, including payment processors, ecommerce tools, email providers, social media platforms, analytics providers, applications, and external websites. Third parties operate under their own terms and privacy practices.

We do not control and are not responsible for the availability, security, accuracy, content, policies, or practices of third party services. A link or reference does not necessarily constitute endorsement.

17. Website Availability and Changes

We may update, correct, suspend, restrict, discontinue, or change the website or any feature at any time. We do not guarantee uninterrupted, error free, or permanently available access.

Maintenance, service provider outages, security events, internet failures, software changes, or circumstances outside our reasonable control may affect availability. We will make reasonable efforts to address material problems but are not responsible for interruptions beyond our reasonable control.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the website, its content, and our products and services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement to the extent those warranties may lawfully be disclaimed.

We do not warrant that the website or a product will meet every expectation, remain compatible with all devices or software, operate without interruption, or produce a particular personal, spiritual, practical, or financial result.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.

19. Limitation of Liability

To the fullest extent permitted by law, Little Moth & Moon, Northside Marketing Inc., and their officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the website, its content, a product, or these Terms.

To the fullest extent permitted by law, our total liability for a claim involving a paid product will not exceed the amount you actually paid for that product. For a claim unrelated to a paid product, our total liability will not exceed one hundred United States dollars.

These limitations do not apply to liability that cannot legally be excluded or limited.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Little Moth & Moon, Northside Marketing Inc., and their officers, employees, contractors, licensors, and service providers from third party claims, damages, liabilities, judgments, losses, and reasonable costs arising from your unlawful conduct, your unauthorized use or distribution of our content, your infringement of another person’s rights, or your material violation of these Terms.

This provision does not require you to indemnify any party for conduct for which indemnification cannot lawfully be required.

21. Suspension and Termination

We may suspend or terminate access to the website, an account, downloads, or services when we reasonably believe there has been fraud, abuse, unauthorized distribution, infringement, a security threat, nonpayment, or a material violation of these Terms.

Termination does not eliminate obligations or rights that by their nature should survive, including payment obligations, ownership provisions, license restrictions, disclaimers, liability limitations, indemnification duties, and dispute provisions.

22. Governing Law and Disputes

Except where mandatory consumer law provides otherwise, these Terms and disputes arising from them are governed by the laws of the State of Texas, without regard to conflict of law principles.

Before filing a legal claim, you and Little Moth & Moon agree to make a reasonable good faith effort to resolve the matter directly. Send a written description of the issue, the requested resolution, and relevant order information through our contact form. This informal process does not prevent either party from seeking urgent legal relief or using a consumer right that cannot be waived.

23. Force Majeure

We will not be responsible for a delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, fire, utility or internet outages, cyberattacks, labor disruptions, government actions, public emergencies, war, civil disturbance, or failure of a critical third party service.

24. Severability and No Waiver

If any provision of these Terms is found unenforceable, that provision will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of that provision or of our right to enforce it later.

25. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of business operations, subject to applicable law.

26. Entire Agreement

These Terms, the Privacy Policy, the Digital Product Policy, applicable product terms, and any additional terms expressly accepted during a transaction constitute the entire agreement between you and us regarding the website and applicable purchase. They replace prior or contemporaneous communications concerning the same subject.

27. Changes to These Terms

We may update these Terms to reflect changes in our website, products, business practices, technology, or legal obligations. Updated Terms will be posted with a revised “Last Updated” date.

Changes will apply prospectively from their effective date unless applicable law requires otherwise. Your continued use of the website after updated Terms take effect signifies your agreement to the revised Terms.
